LSAC Privacy Notice

Law School Admission Council, Inc. and its affiliates (collectively, “LSAC,” “we,” “our” or “us”) are committed to privacy and to transparency in our information practices.  In this Privacy Notice (“Notice”), we describe our collection, use, disclosure and processing of Personal Information that we collect in relation to our Services.

Scope of this Notice

This Notice explains how LSAC, a registered not-for-profit organization, collects, uses, discloses and otherwise processes information when you use our Websites (including but not limited to lsac.org, lawhub.org, lsac.zendesk.com, and lawschooltransparency.com, collectively referred to as the “Websites”), purchase our products or services, take the Law School Admission Test (including without limitation our LSAT Writing, LSAT Argumentative Writing, and tests administered outside the fifty United States, collectively referred to as the “LSAT”),  apply for law school, attend our events, or otherwise interact with us as a consumer or service provider (collectively, the “Services”).  

Our collection, use, disclosure, and other processing of Personal Information about individuals will vary depending upon the circumstances. This Notice is intended to describe our overall privacy and data protection practices. 

In this Notice, our use of the term “Personal Information” includes other similar terms under applicable privacy laws—such as “personal data” and “personally identifiable information.”  In general, Personal Information includes any information that identifies, relates to, describes, or is reasonably capable of being associated, linked, or linkable with a particular individual. Personal Information does not include anonymous information that cannot be used, alone or in combination with other information, to identify a particular individual.

LSAC reserves the right to change this Notice at any time. If we decide to change our Notice, we will notify you by revising the date at the top of the Notice. We encourage you to review this Notice whenever you access our Websites to stay informed about our information practices and the choices available to you.

How We Collect and Use Your Personal Information

We collect Personal Information directly from you and from other sources (e.g., schools you attend(ed), test proctors, qualified professionals (supporting reasonable accommodations), recommenders, credential reviewers, etc.) for a variety of purposes, depending on how you use our Services. Personal Information we may collect includes:

  • When you create an online account with LSAC or LawHub, we will collect (or retrieve from our existing records) your account login credentials and name and contact information (including address). We will also collect (or retrieve from our existing records) additional types of Personal Information that vary depending upon the type of account you create, including but not limited to the company or institution you are associated with, your role with your company or institution, LSAC-issued identification number, date of birth, gender identity (including preferred pronouns), personal identification number provided by you (or generated by LSAC if not provided by you),  communication and/or data sharing preferences, address, your education history, and your parents’ education history. We may also collect some information that may be considered sensitive Personal Information under some laws, such as information about race, ethnicity, status as transgender or nonbinary, sexual orientation, and mental or physical health conditions or diagnoses (e.g., accessibility preferences). Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to create an LSAC or LawHub account. At the time you create an account, we will specify each type of Personal Information we will collect and whether you are required to provide it to create an account. We use this information for purposes including but not limited to:
    • Providing Services that you request;
    • Maintaining and customizing your account and our interactions with you;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Performing restricted party screening as needed to comply with United States export control laws;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites;
    • Processing Personal Information on behalf of schools that use LSAC’s Services (e.g., application management, Legal Education Consulting, etc.); and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you register for the LSAT, we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, test administration logistical information (e.g., your preferred and actual testing modality, date, time, and location; test material shipping destination; handedness; languages spoken; etc.), your photograph, assistive technology preferences, date of birth, federal financial aid information, gender identity, LSAC-issued identification number, government-issued identification number, your education history, and your relatives’ education history.  We may also collect (or retrieve from our existing records) some information that may be considered sensitive Personal Information under some laws, such as information about race, ethnicity, status as transgender or nonbinary, sexual orientation, and citizenship status. Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to register for the LSAT. At the time you register for the LSAT, we will specify each type of Personal Information we will collect and whether you are required to provide it to register for the LSAT. Information we collect when you register for the LSAT is merged with the information we collected when you created your LSAC account (as described above), and we use this combined information for purposes including but not limited to:
    • Delivering the testing materials you requested and facilitating your test-taking;
    • Maintaining and customizing your account and our interactions with you;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you request LSAT testing modifications or accommodations, we will collect from you (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, LSAC-issued identification number, date of birth, test date, information about previously requested testing accommodations, information about mental or physical health conditions or diagnoses, and type(s) of testing accommodations requested and/or provided. We will also collect from you prior documentation of your disability, or if you do not have prior documentation, we will require you to collect additional information from a person you identify who is licensed or otherwise properly credentialed and possesses expertise in the disability for which you are seeking testing modifications or accommodations (“Qualified Professional”). Additional information we require you to collect from your Qualified Professional includes without limitation your disability/diagnostic code, date of diagnosis, medical examination history, disability documentation (e.g., a comprehensive medical evaluation, relevant medical history, etc.), and type(s) of testing accommodations recommended. At the time you request testing accommodations, we will specify each type of Personal Information we will collect and whether you are required to provide it to request testing accommodations. We use this information for purposes including but not limited to:
    • Assessing and responding to your accommodations request;
    • Deciding upon your accommodations request;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you support a request for testing modifications or accommodations as a Qualified Professional, we will ask the individual you are supporting to collect your Personal Information including but not limited to your name and contact information, professional credentials, and professional qualifications. At the time they collect your Personal Information, we require them to provide a form specifying each type of Personal Information we will collect and whether you are required to provide it to support their request for testing accommodations. We collect this information from the individual you are supporting and use this information for purposes including but not limited to:
    • Verifying that you are licensed or otherwise properly credentialed and possess expertise in the disability for which you are supporting testing modifications or accommodations;
    • Assessing and responding to the accommodations request you are supporting; and
    • Deciding upon the accommodations request you are supporting.
  • When you take the LSAT, we will collect (or retrieve from our existing records) Personal Information including but not limited to your record of attendance, LSAT results and score analysis, any Personal Information you choose to provide in your writing sample, name and contact information, LSAC-issued identification number, government-issued identification number and any other information on your government-issued identification card, date of birth, and images and audio and video recordings of you and your immediate surroundings taken during the test process (including arrival and departure). When you take the LSAT online, including when you complete the LSAT Writing or LSAT Argumentative Writing, we will also automatically collect information about how you access and use our online platform, including information collected from cookies and web beacons. We use this information for purposes including but not limited to:
    • Facilitating your taking of the LSAT;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you use our Credential Assembly Services (CAS) to apply to law school or share your Personal Information with schools you are interested in (including our Letter of Recommendation Service, LLM CAS, Electronic Application Service, Document Assembly Service, and International Transcript Authentication and Evaluation Service), we will collect from you (or retrieve from our existing records) Personal Information that varies depending upon whether you are using our JD or LLM CAS, including but not limited to your name and contact information; date of birth; place of birth; gender identity; LSAC-issued identification number; LSAT score, LSAT Writing Sample, LSAT Argumentative Writing Sample, and testing location; languages spoken; communication preferences; information about law school(s) at which you are interested in applying; any Personal Information that is requested on the law school application(s) you choose to complete, which varies depending upon the school; and any Personal Information you choose to include in your personal statement. We may also collect (or retrieve from our existing records) some information that may be considered sensitive Personal Information under some laws, such as information about citizenship status. Some information that we may ask you to voluntarily provide is not required in order to use our CAS. At the times you register for CAS and complete each law school application, we will specify each type of Personal Information we will collect and whether you are required to provide it to use our CAS. We will also collect from you information about educational institutions you previously attended, and if you request academic transcripts and/or other academic records (e.g., certificate of graduation, degree, diploma, diploma supplement, etc.) from such institutions, then we will collect such records directly from the relevant institutions or electronic transcript transfer delivery services. If you request score results (e.g., English proficiency exam scores) from testing services, then we will collect such score results directly from the relevant testing services. We will also collect your Personal Information from recommenders of your choice, including information about your relationship with them, your character and fitness, and any other information your recommenders choose to provide in their letters of recommendation. We combine all this information and use it for purposes including but not limited to:

    • Fulfilling your request(s) to apply to law schools of your choice, which includes without limitation authenticating and evaluating your international transcripts and other academic records and/or summarizing your transcripts, as required by the law schools you apply to;
    • Fulfilling your request(s) to share your Personal Information with law schools of your choice, which may include schools you do not apply to;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites;
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology; and
    • Sharing (with your consent) your Personal Information with law schools, including schools you did not apply to, and legal education support programs, in order to further their research, development, and marketing initiatives.

    After your application is submitted to a law school, the law school will use your Personal Information for its own purposes, which you may learn more about by inquiring directly with the law school. LSAC is not responsible for how your application information is used or otherwise handled after it is submitted to a law school.

  • When you sign up for our Candidate Referral Service (CRS) (including our LLM CRS), we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, LSAC-issued identification number, State of permanent residence, gender identity, education history, employment information, and law school preferences. We will also collect any other information described on our CRS webpage. We may also collect some information that may be considered sensitive Personal Information under some laws, such as information about race, ethnicity, country of citizenship, and status as a part of the LGBTQ+ Community. Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to use our CRS. At the time you sign up for our CRS, we will specify each type of Personal Information we will collect and whether you are required to provide it to use our CRS. We use this information for purposes including but not limited to:
    • Fulfilling your request to share this information with law schools, agencies or individuals working on their behalf, and other eligible programs or organizations related to legal education, in order to help law schools recruit you based on specific characteristics;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you sign up for an LSAC listserv (e.g., RISE Alliance), we may collect from you or the institution you work for (depending upon the type of listserv and your professional role) Personal Information including but not limited to your name and contact information, your institutional affiliation, and job title. At the time you sign up for a listserv, we will specify each type of Personal Information we will collect and whether you are required to provide it to sign up for the listserv. We use this information for purposes including but not limited to:
    • Developing and sending communications relevant to the listserv topic (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you purchase our Services, we will collect (or retrieve from our existing records) Personal Information including but not limited to your payment information, name and contact information, LSAC-issued identification number, and date of birth. We will also generate and maintain a record of your purchases. We use this information for purposes including but not limited to:
    • Processing your payment or refund;
    • Delivering the Services you requested;
    • Maintaining and customizing your account and our interactions with you;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;

    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When we believe you may be interested in providing philanthropic support, we may collect Personal Information from you, publicly available resources (e.g., public directories, social media websites, etc.), or private databases. Such Personal Information include without limitation your name and contact information. If you choose to provide philanthropic support, we will collect (or retrieve from our existing records) Personal Information including but not limited to your payment information and name and contact information. We use this information for purposes including but not limited to:
    • Contacting you to inform you of LSAC’s philanthropic endeavors and opportunities (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Processing your payment or refund;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Performing restricted party screening as needed to comply with United States export control laws; and

  • When you request customer support and otherwise communicate with us, we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, any information previously provided or generated when using our Services, and any information you choose to provide in relation to your support request or other communications, such as your LSAC/LawHub account activities and information about the devices you use to interact with us. We use this information for purposes including but not limited to:
    • Responding to your communications and assisting you in the manner requested;
    • Providing Services that you request;
    • Distributing and processing Customer Satisfaction surveys;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you complete a voluntary LSAC survey, we will collect types of Personal Information that vary from survey to survey, which may include some information that may be considered sensitive Personal Information under some laws. All information, including sensitive Personal Information, is voluntarily provided and is not required in order to use LSAC’s other Services. At the time you complete a survey, we will specify each type of Personal Information we will collect and whether you are required to provide it to complete the survey. Information we collect when you complete a survey is merged with any information we collect when you use our other Services (as described throughout this Notice), and we use this combined information for purposes including but not limited to:
    • Processing your survey responses;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you attend our events, we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information and additional Personal Information that varies depending upon the type of event, such as your institutional affiliation, your professional role, LSAC-issued identification number, date of birth, gender identity, education history, image (via photo and/or video), emergency contact information, and dietary preferences. We may also collect (or retrieve from our existing records) some information that may be considered sensitive Personal Information under some laws, such as information about your status as transgender or nonbinary, and mental or physical health conditions or diagnoses (e.g., accommodation requests). Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to attend our events. At the time you sign up for our events, we will specify each type of Personal Information we will collect and whether you are required to provide it to attend our events. We use this information for purposes including but not limited to:
    • Facilitating your event participation;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education;
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you are identified as an emergency contact for someone using our Services, we will collect from the person who identifies you as their emergency contact your name, contact information, and information about your relationship with the person who identified you as their emergency contact. We use this information to contact you in the event of an emergency.
  • When you apply to receive a fee-waiver, we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information; LSAC-issued identification number; government-issued identification number; date of birth; country of citizenship; marital status; status as a military veteran; tax dependency status and expenses; tax filing status; federal financial aid information; and information regarding you and your family’s income, assets, and expenses. We will also collect supporting documentation, which varies based on your citizenship status (see Fee Waivers for LSAC Programs and Services for detailed information about the types of supporting documentation collected). Some information we collect (or retrieve from our existing records) may be considered sensitive Personal Information under some laws, such as your country of citizenship. We use this information for purposes including but not limited to:
    • Evaluating your eligibility to receive a fee-waiver in accordance with applicable laws and LSAC policies and procedures;
    • Effectuating fee-waivers;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies and conducting research ourselves or jointly with others related to our products and Services and the use of our Websites; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you visit our Websites (including but not limited to lsac.org, lawhub.org, lsac.zendesk.com, and lawschooltransparency.com) or use our online Services, certain Personal Information will be passively collected, meaning it will be gathered without your actively providing it. We use different technologies to collect such information, including cookies and web beacons. The types of information we collect and the purposes we use them for vary depending upon the consent settings you choose when you access our Websites (for more information about cookies and how to disable them through your consent settings, see our Cookie Notice). Such purposes may include but are not limited to:
    • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Generating aggregate statistical studies to use internally or to provide to schools and other eligible programs related to legal education; and
    • Conducting research ourselves or jointly with others related to our Services and the use of our Websites.
  • When a school you attend(ed) uses our Services (e.g., application management, Legal Education Consulting Services, etc.) we may collect any types of Personal Information that your school chooses to provide, which varies depending upon the school and the type of Service. We process this information on behalf of your school, in accordance with the purposes and means determined by your school, and we may combine it with your Personal Information from our existing records in order to provide our Services to your school.
  • When an institution you work for uses our Services (e.g., application management, Legal Education Consulting Services, Prelaw Advisor Services, LSAC Ambassador Services, etc.), we may collect from you or your institution (depending upon your professional role and the Services your institution uses) Personal Information related to your professional role, such as your institutional affiliation, job title, name and professional contact information, and headshot or other identification photo. We use this information for purposes including but not limited to:
    • Providing Services that you or your institution request;
    • Connecting you with members of the legal education community, such as current students, prospective students, and legal education professionals;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Developing and sending marketing communications about products, services, offers, and events offered by LSAC and others, and providing news and information we think will be of interest to you (you can unsubscribe from these communications at any time, see Your Choices below for details);
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.
  • When you provide services to us (e.g., as an independent contractor, volunteer, or other non-LSAC employee), we collect Personal Information including but not limited to your name and contact information. We may also collect additional Personal Information that varies depending upon the services you provide, such as your organizational affiliation, professional or volunteer role, professional biographical information, and passport information (if we book international travel on your behalf). We use this information for purposes including but not limited to:
    • Facilitating your provision of services;
    • Sending you payments for your work or gifts for your volunteer service;
    • Maintaining and customizing your account and our interactions with you;
    • Sending you technical notices, updates, security alerts, and support and administrative messages, and responding to your comments, questions, and customer service requests;
    • Monitoring and analyzing trends, usage, and activities in connection with our Services;
    • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others;
    • Performing restricted party screening as needed to comply with United States export control laws; and
    • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.

Sensitive Information: Unless we specifically request or invite it, we ask that you not send or otherwise disclose to us your racial or ethnic origin, political opinions, religion or other beliefs, health, disabilities, accessibility and/or accommodation needs, criminal background, or trade union membership. In those cases where we may request or invite you to provide the foregoing information, we will only do so with your express consent, in accordance with applicable data protection law requirements. Where you provide us with such information without request from LSAC, we reserve the right to erase any such information at our discretion.

Information about children: As our Services are adult-oriented, we do not knowingly collect Personal Information online from persons that are sixteen (16) years of age or younger.

We reserve the right to delete any data identified as having been provided by such persons at our discretion.

Other Uses of Your Personal Information

In addition to the purposes described above, we may use any Personal Information that we collect at any time to:

  • Comply with applicable legal requirements;
  • Investigate, exercise, prepare for, or defend actual or anticipated legal claims;
  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by governmental authorities;
  • Cooperate with law enforcement agencies concerning conduct or activities that we reasonably and in good faith believe may violate applicable law;
  • Protect your vital interests or the vital interests of another individual;
  • Prevent, detect, protect against, or respond to security incidents, identity theft, fraud, harassment, or malicious, deceptive, or illegal activity; preserve the integrity or security of systems; or investigate, report, or prosecute those responsible for any such action; and
  • Carry out any other purpose described to you at the time the information was collected.

We may also use your Personal Information in other ways, if you consent to those uses.

How We Disclose Your Personal Information

We may disclose Personal Information as follows:

  • When you use our CAS Services to apply to law school, as described above, and submit a law school application, we disclose Personal Information to the relevant law school(s) to facilitate the application process and enable the law school(s) to communicate directly with you. If you are subject to a security investigation, we may also disclose Personal Information related to the pending or completed investigation to schools you are applying to or have applied to, in order to detect, investigate, prevent, and address possible misconduct or irregularities on the LSAT or in the law school admission process;
  • When you apply to a school that requests LSAC to provide your LSAT score, LSAT Argumentative Writing Sample and/or LSAT Writing sample, we will disclose your LSAT Law School Report, in order to fulfill the request and facilitate your law school application. If you are subject to a security investigation, we may also disclose Personal Information related to the pending or completed investigation to schools you are applying to or have applied to, in order to detect, investigate, prevent, and address possible misconduct or irregularities on the LSAT or in the law school admission process;
  • When you sign up for our CRS, as described above, we disclose Personal Information to law schools, agencies or individuals working on their behalf, and other eligible programs or organizations related to legal education (our CRS Information Recipients list identifies such programs and organizations), in order to fulfill your request to enable law schools to recruit you based on specific characteristics, including sending you promotional materials about their programs, events, and other information that may be of interest to you. For information about how to cancel your CRS enrollment and opt out of having your information shared in this way, see the “Your Choices” section below;
  • When you create your LSAC JD Account or participate in our CRS or CAS services, with your consent we may disclose your Personal Information to law schools, agencies or individuals working on their behalf, and other eligible programs related to legal education that use your Personal Information for their own research and marketing purposes. With your consent, we may also disclose your Personal Information to service providers that anonymize your Personal Information to be subsequently used for additional marketing purposes. For information about how to withdraw your consent, see the “Your Choices” section below;
  • When you visit our Websites or use our online Services, as described above, we may disclose Personal Information to third-party advertisers that provide analytics services and serve advertisements on our behalf across the internet and in applications if you provide your consent for us to do so. Some advertisements are selected to be displayed to you based on Personal Information obtained or inferred over time from your activities across nonaffiliated websites, applications, or online services to predict your preferences or interests and to display advertisements that may be of interest to you, which is also known as “targeted advertising.” If you provide your consent for us to disclose your Personal Information to such third-party advertisers, you may withdraw your consent at any time by reviewing your cookie consent settings;
  • When we collect your Personal Information for any purpose described above, as needed, we may also disclose your Personal Information—
    • To service providers, vendors, and consultants that process Personal Information on our behalf (referred to as “processors” under some laws), such as those that operate test centers or administer tests, host learning management systems or other online platforms, process payments, review accommodation requests, evaluate academic credentials, provide restricted party screening services, provide customer service, or provide marketing or research support;
    • To government agencies, offices, or appointees and to private consultants (e.g., legal consultants, restricted party screening service providers, etc.) for legal reasons (e.g., to prevent crime or fraud; assist investigations; comply with legal obligations, such as export control obligations; comply with a court orders or rules; protect and defend LSAC’s rights and property; protect the safety of our customers and/or the public; protect against legal liability; etc.);
    • To an acquiring entity in connection with, or during negotiations of, any merger, sale of assets, financing, or acquisition of all or a portion of our business by another entity;
    • To, and between and among, LSAC’s current and future parents, subsidiaries, affiliates, and other entities under common control and ownership; and
    • To any other third parties with your consent and at your direction.

We also process and share anonymous data that does not identify you personally, including without limitation aggregated data derived from Personal Information (such as information about LSAC.org traffic patterns), provided that such aggregated data derived from your Personal Information does not include any inferences about you specifically, and cannot be used alone or in conjunction with other information to identify you; such data is outside the scope of this Notice. Primarily, we use and share such aggregated data directly with schools and other organizations involved in the legal education community, as well as with the general public when we develop and publish research reports based on such aggregated data. While the purpose of each research report varies on a case-by-case basis, overall our reports are intended to demonstrate the validity of LSAT scores as a strong predictor of a student’s future success in law school; to help schools in their efforts to attract and retain qualified students; and to help LSAC, schools, and other organizations involved in the legal education community to understand the needs of the legal education community in order to offer and improve our Services and their services. After Personal Information has been aggregated as described above, we will not attempt to re-identify the aggregated data, but we may retain the Personal Information from which the aggregated data was derived and may use such Personal Information as described in this Notice.

Managing Your LSAC.org Account

You may review, update, or modify your account information, including profile and contact information, at any time by logging into your LSAC.org account.

Managing Your LawHub.org Account

You may review, update, or modify your account information, including profile and contact information, at any time by logging into your LawHub.org account.

Opting out of LSAC Promotional Communications

You may unsubscribe from LSAC’s promotional emails and communications at any time by following the instructions included in those emails or your LSAC or LawHub account (as applicable). If you opt out of receiving such communications, note that we may continue to send you non-promotional emails (such as LSAT registration and application submission confirmation emails or emails about changes to our legal terms and policies).

Opting out of Promotional Communications from Law Schools and Related Individuals and Organizations

If you request to engage in our CRS, we share information about you with law schools and related individuals and organizations as described in the “How We Collect and Use Your Personal Information” and “How We Disclose Your Personal Information” sections above. If you cancel your request to engage in our CRS, we will stop sharing such information with such CRS recipients. However, the CRS recipients that we shared information with before you canceled your request may continue to contact you. If you want to unsubscribe from these communications, you will need to contact the CRS recipients directly and/or follow the opt-out instructions provided in their communications or their respective privacy policies. To cancel your CRS request and to request that LSAC stop sharing your information with CRS recipients going forward, please log on to your LSAC account, go to the Candidate Referral Services page, and opt-out of LSAC sharing your information with CRS recipients.

Opting out of LSAC JD Account and CAS Data Sharing

If you provide your consent for us to disclose your Personal Information when you create your LSAC JD Account or participate in our CAS services, as described in the “How We Collect and Use Your Personal Information” and “How We Disclose Your Personal Information” sections above, you may withdraw your consent at any time by adjusting the settings within your LSAC JD Account.

Opting out of Targeted Advertising

If you provide your consent for us to disclose your Personal Information to third-party advertisers, as described in the “How We Collect and Use Your Personal Information” and “How We Disclose Your Personal Information” sections above, you may withdraw your consent at any time by reviewing your cookie consent settings.

Your Rights

You may have certain rights regarding the processing of your Personal Information, and these rights may be subject to limitations and exceptions resulting from applicable laws. Data Transfers

LSAC is based in the United States and we and our vendors process and store Personal Information in the United States and, if you take the LSAT outside of the United States, other jurisdictions. The United States and these other jurisdictions may not provide equivalent levels of data protection as your home jurisdiction. We transfer Personal Information across borders and may transfer your personal information outside your jurisdiction of residence when we have your consent to do so, or when such processing is otherwise permitted under applicable laws (for example, when the processing is subject to appropriate safeguards and legal rights and remedies). We take steps to safeguard your Personal Information in a manner that provides an adequate level of protection in the jurisdictions in which we process it.

Retention of Data

Our retention periods for Personal Information are based on our business needs and legal requirements. We retain Personal Information for as long as is necessary for the processing purpose(s) for which the information was collected, and any other permissible, related purpose. To investigate, exercise, prepare for, or defend actual or anticipated legal claims, we may also retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired.
