Washington My Health My Data Act Privacy Policy

Law School Admission Council, Inc. and its affiliates (collectively, “LSAC,” “we”, “our” or “us”) are committed to privacy and to transparency in our information practices. In this Consumer Health Data Privacy Policy (“CHD Privacy Policy”), we provide information about how we collect and use Consumer Health Data, as such term is defined under the Washington My Health My Data Act (2023 Wash. Laws 191) (“WA MHMD Act”).

This CHD Privacy Policy applies only to Consumer Health Data that is subject to the WA MHMD Act and does not apply to information that is not subject to the WA MHMD Act. Capitalized terms used in this CHD Privacy Policy, which are not otherwise defined, have the meanings assigned to them in the LSAC Privacy Notice.

How We Collect and Use Consumer Health Data

LSAC is committed to providing necessary testing accommodations to candidates with documented disabilities, such as testing accommodations for the LSAT and LSAT Argumentative Writing. We collect and use Consumer Health Data in connection with processing requests for testing accommodations (“Accommodations Consumer Health Data”).

We also collect and process other Consumer Health Data on behalf of schools in connection with our Services we provide to schools (“School Consumer Health Data”). The ways that we collect and use Accommodations Consumer Health Data and School Consumer Health Data are described in detail below.

Categories of Consumer Health Data We Collect

Accommodations Consumer Health Data

When you request a testing accommodation, we will collect any information and documentation you choose to provide about your mental or physical health conditions or diagnosis, previously requested testing accommodations, or current request for testing accommodations. Such information may include:

  • Whether you were previously approved to receive testing accommodations and proof of approval;
  • Types of testing accommodations you are currently requesting;
  • An explanation as to why you need the requested testing accommodations;
  • The nature of your disorder/condition;
  • Your specific diagnosis (e.g., disability/diagnostic code, dates of diagnosis and most recent examination, diagnosing doctor, etc.);
  • Documentation of a disability (e.g., documentation in a previous Individualized Education Program or Section 504 Plan; a comprehensive medical evaluation; relevant medical history; standardized test data from medical evaluation instruments; a written statement describing your disability, impairment, areas of limitation, effects on test taking, and accommodation needs; etc.); and
  • Any other information or documentation you choose to provide about your mental or physical health conditions or diagnosis, previously requested testing accommodations, or current request for testing accommodations.

School Consumer Health Data

When you apply to or attend a school that uses our Services (e.g., application management, Legal Education Consulting Services, etc.), we collect any type of data the school requests on its enrollment application (including without limitation information you provide in your personal statement) or provides to us directly in relation to our Services (e.g., information related to your vaccination history). The type of data we collect varies depending on the school and the type of Service we provide to it. To learn more about the types of data we collect on behalf of a particular school, you should contact the school directly.

How We Collect Consumer Health Data

Accommodations Consumer Health Data

We collect Accommodations Consumer Health Data directly from you. In some cases, you may need to collect and provide us with Accommodations Consumer Health Data from a person you identify who is licensed or otherwise properly credentialed and possesses expertise in the disability for which you are seeking testing accommodations.

School Consumer Health Data

We collect some School Consumer Health Data directly from you when you provide it in conjunction with your enrollment application(s), and we collect some School Consumer Health Data from schools when they provide it to us in conjunction with our Services.

Purposes for Which We Use Consumer Health Data

Accommodations Consumer Health Data

We use Accommodations Consumer Health Data for the following purposes:

  • Assessing and responding to your accommodations request;
  • Evaluating your accommodations request;
  • Monitoring and analyzing trends, usage, and activities in connection with our Services;
  • Detecting, investigating, preventing, and addressing possible misconduct or irregularities on the LSAT or in the law school admission process;
  • Detecting, investigating, preventing, and addressing fraudulent transactions and other illegal activities and protecting the rights and property of LSAC and others; and
  • Conducting research, training, and other internal work to maintain, improve, repair, or develop our Services, workforce, or technology.

School Consumer Health Data

We process School Consumer Health Data in order to provide our Services to schools. We process School Consumer Health Data on behalf of schools, and such schools determine the purposes for which we process School Consumer Health Data. To learn more about the purposes for which we process School Consumer Health Data on behalf of a particular school, you should contact the school directly.

Non-Sharing of Consumer Health Data

We do not share any Consumer Health Data with Third Parties or Affiliates, as such terms are defined under the WA MHMD Act.

How to Exercise Your Rights

If you are a natural person acting only in an individual or household context, and you are a resident of the State of Washington or someone whose Consumer Health Data is collected in Washington, you have certain rights provided under section 6 of the WA MHMD Act.
