This PIPL Privacy Notice (the “PIPL Notice”) applies to the Handling of Personal Information (as defined herein), by Law School Admission Council, Inc. and its affiliates (collectively, “LSAC,” “we,” “our,” or “us”) subject to the Personal Information Protection Law of the People’s Republic of China (“China”) (“PIPL”), through its website, products, and services, including but not limited to the Law School Admission Test (including without limitation our LSAT Writing and tests administered outside the fifty United States, collectively referred to as the “LSAT”), law school application services, educational services, events, and other services provided by LSAC (the “Services”).
本PIPL隐私通知(简称“PIPL通知”)适用于法学院入学委员会及其关联机构(统称“LSAC”、“我们”)根据《中华人民共和国(简称“中国”)个人信息保护法》(简称“PIPL”)通过其网站、产品和服务,包括但不限于法学院入学考试(包括但不限于我们的LSAT写作和在美国五十个州以外地区举行的考试,统称为 “LSAT”)、法学院申请服务、教育服务、活动以及LSAC提供的其他服务(简称“服务”)处理个人信息(定义见下文)。

This PIPL Notice describes how we collect, use, disclose, transfer, and protect such Personal Information, your rights and choices with respect to your Personal Information, how this PIPL Notice will be updated, and how you can contact us if you have any questions or concerns. For the purposes of this PIPL Notice, “Mainland China”, “PRC” or “China” shall refer to the continental landmass under the direct control of the PRC, including the islands of Hainan Province and five major autonomous regions (i.e., Tibet, Inner Mongolia, Xinjian, Ningxia, and Guangxi), but excluding the Hong Kong Special Autonomous Region (SAR), and Macao SAR.

Scope of this PIPL Notice/本PIPL通知的适用范围

This PIPL Notice applies to you if LSAC Handles your Personal Information in the following ways:

  • Inside China: LSAC Handles your Personal Information within the borders of the PRC; or

  • Outside China: You are physically located in China, and LSAC Handles your Personal Information outside the borders of China in order to 1) provide you goods or services, 2) analyze or assess your activities, or 3) comply with other circumstances as provided by Chinese laws or administrative regulations, including the Civil Code of the People's Republic of China, the Cybersecurity Law of the People's Republic of China, the Data Security Law of the People's Republic of China, the Personal Information Protection Law of the People's Republic of China, the Measures for the Standard Contract for the Outbound Transfer of Personal Information and other laws, regulations and departmental rules of the People's Republic of China.

If you are located outside China and you provide your Personal Information to LSAC outside China, this PIPL Notice does not apply to that information.

How We Collect and Use Your Personal Information /我们如何收集和使用您的个人信息

In this PIPL Notice, “Personal Information” means any information, recorded by electronic or other means, relating to an identified or identifiable individual and does not include information that underwent anonymization. We may collect Personal Information about you from various sources described below. “Handle” or “Handling” as used in this PIPL Notice means any operation or set of operations performed on Personal Information or on sets of Personal Information, whether or not by automated means, and includes the collection, storage, use, processing, transmission, provision, publication, and erasure of Personal Information.

Communications and data sharing preferences, communications records and content, emails, data that describe personal communications (often referred to as metadata), technical and other support requests submitted by you or on your behalf, etc.

Personal web surfing record

Refers to records of a PI Subject’s operations stored in server logs, including web browsing records, software use records, click records, access times, etc.

Information of frequently used equipment

Refers to the information identifying the equipment often used by an individual, including hardware serial number, equipment MAC address, list of software, and unique equipment identifier (e.g. IMEI/Android ID/IDFA/Open UDID/GUID, SIM card IMSI information).

Other information

Photo (for LSAT admission ticket), information about race, ethnicity, gender identity, status as transgender or nonbinary, religious affiliation, sexual orientation, test administration logistical information (e.g., your preferred and actual testing modality, date, time, and location; test material shipping destination; handedness; languages spoken; etc.), images and audio and video recordings of you and your immediate surroundings taken during the test process (including arrival and departure), precise location information, law school preferences, character and fitness information,  disabilities, parents’ and other family’s educational experience, etc.

We may Handle the following kinds of Sensitive Personal Information:

Unless we specifically request or invite it, we ask that you not send or otherwise disclose to us your Sensitive Personal Information.  In those cases where we may request or invite you to provide Sensitive Personal Information, we will only do so with your express consent, in accordance with applicable data protection law requirements. Where you provide us with Sensitive Personal Information without request from LSAC, we reserve the right to erase any such information at our discretion.

Such Personal Information, including Sensitive Personal Information, may be collected and Handled by LSAC in the following manners:

  • When you create an online account with LSAC or LawHub, we will collect (or retrieve from our existing records) your account login credentials and name and contact information (including address). We will also collect (or retrieve from our existing records) additional types of Personal Information that vary depending upon the type of account you create, including but not limited to the company or institution you are associated with, your role with your company or institution, LSAC-issued identification number, date of birth, gender identity (including preferred pronouns), personal identification number provided by you (or generated by LSAC if not provided by you), communication and/or data sharing preferences, address, your education history, and your parents’ education history. We may also collect some information that may be considered sensitive Personal Information under some laws, such as information about race, ethnicity, status as transgender or nonbinary, sexual orientation, and mental or physical health conditions or diagnoses (e.g., accessibility preferences). Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to create an LSAC or LawHub account. At the time you create an account, we will specify each type of Personal Information we will collect and whether you are required to provide it to create an account. We use this information for purposes including but not limited to:

  • When you register for the LSAT, we will collect (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, test administration logistical information (e.g., your preferred and actual testing modality, date, time, and location; test material shipping destination; handedness; languages spoken; etc.), your photograph, assistive technology preferences, date of birth, federal financial aid information, gender identity, LSAC-issued identification number, government-issued identification number, your education history, and your relatives’ education history.  We may also collect (or retrieve from our existing records) some information that may be considered sensitive Personal Information under some laws, such as information about race, ethnicity, status as transgender or nonbinary, sexual orientation, and citizenship status. Some information that we may ask you to voluntarily provide, including sensitive Personal Information, is not required in order to register for the LSAT. At the time you register for the LSAT, we will specify each type of Personal Information we will collect and whether you are required to provide it to register for the LSAT. Information we collect when you register for the LSAT is merged with the information we collected when you created your LSAC account (as described above), and we use this combined information for purposes including but not limited to:

  • When you request LSAT testing modifications or accommodations, we will collect from you (or retrieve from our existing records) Personal Information including but not limited to your name and contact information, LSAC-issued identification number, date of birth, test date, information about previously requested testing accommodations, information about mental or physical health conditions or diagnoses, and type(s) of testing accommodations requested and/or provided. We will also collect from you prior documentation of your disability, or if you do not have prior documentation, we will require you to collect additional information from a person you identify who is licensed or otherwise properly credentialed and possesses expertise in the disability for which you are seeking testing modifications or accommodations (“Qualified Professional”). Additional information we require you to collect from your Qualified Professional includes without limitation your disability/diagnostic code, date of diagnosis, medical examination history, disability documentation (e.g., a comprehensive medical evaluation, relevant medical history, etc.), and type(s) of testing accommodations recommended. At the time you request testing accommodations, we will specify each type of Personal Information we will collect and whether you are required to provide it to request testing accommodations. We use this information for purposes including but not limited to:

  • When you support a request for testing modifications or accommodations as a Qualified Professional, we will ask the individual you are supporting to collect your Personal Information including but not limited to your name and contact information, professional credentials, and professional qualifications. At the time they collect your Personal Information, we require them to provide a form specifying each type of Personal Information we will collect and whether you are required to provide it to support their request for testing accommodations. We collect this information from the individual you are supporting and use this information for purposes including but not limited to:

  • When you take the LSAT, we will collect (or retrieve from our existing records) Personal Information including but not limited to your record of attendance, LSAT results and score analysis, any Personal Information you choose to provide in your writing sample, name and contact information, LSAC-issued identification number, government-issued identification number and any other information on your government-issued identification card, date of birth, and images and audio and video recordings of you and your immediate surroundings taken during the test process (including arrival and departure). When you take the LSAT online, including when you complete the LSAT Writing, we will also automatically collect information about how you access and use our online platform, including information collected from cookies and web beacons. We use this information for purposes including but not limited to:

While the purpose of each research report varies on a case-by-case basis, overall our reports are intended to demonstrate the validity of LSAT scores as a strong predictor of a student’s future success in law school; to help schools in their efforts to attract and retain qualified students; and to help LSAC, schools, and other organizations involved in the legal education community to understand the needs of the legal education community in order to offer and improve our Services and their services. After Personal Information has been aggregated as described above, we will not attempt to re-identify the aggregated data, but we may retain the Personal Information from which the aggregated data was derived and may use such Personal Information as described in this PIPL Notice.

As provided under applicable Chinese law and subject to any limitations in such law, you have the following rights, which you may also exercise on behalf of a deceased person to whom you are the next of kin, for the sake of your own lawful and legitimate interests, except where the deceased has arranged otherwise before death:

  • Right to Withdraw Consent. If you have provided your consent to our Handling or transfer out of China of your Personal Information and/or Sensitive Personal Information, you may withdraw your consent at any time by contacting LSAC.   Withdrawal of consent will not be retroactive and will not affect the lawfulness of the Handling or transfer of Personal Information, including Sensitive Personal Information, Handled by LSAC prior to your withholding or withdrawing of consent. If you withdraw or withhold your consent, LSAC may continue to Handle your Personal Information, including Sensitive Personal Information, in accordance with the legal obligations relating to your status as a test taker with LSAC or if LSAC otherwise has a legal basis for the Handling.

You may exercise these rights by contacting us as described below, under How to Contact LSAC and  Exercise Your Rights, and we will respond. We will not charge you for your reasonable requests in principle. However, a fee to reflect the cost will be imposed as appropriate on repeated requests beyond reasonable scope. We may reject repeated requests that are groundless and need excessive technological means (e.g. developing a new system or fundamentally changing the current practices) to fulfill, bring about risks to others’ legitimate rights and interests, or are downright impractical (e.g. involving information stored on a backup disk).

Note that applicable laws contain certain exceptions and limitations to each of these rights. We will not be able to respond to your request when it: affects our compliance with obligations under applicable laws and regulations; directly relates to national security or defense security; directly relates to public security, public health, or major public interests; directly relates to criminal investigations, prosecutions, trials, and enforcement of court decisions, etc.; or involves trade secrets. We also will not respond to requests when we have sufficient proof that you have subjective malice or are abusing your rights; for the purpose of safeguarding your life, property, or your other important legal rights and interests or those of other individuals from whom it is difficult to obtain consent; or when responding to your request would cause serious harm to your legitimate rights and interests, or those of other individuals or organizations.

If we do not grant your rights request, we will explain the reason for doing so. For security, we may require you to submit your request in writing, and we will also need to verify your identity before you exercise these rights to ensure that your Personal Information is not inappropriately disclosed.

International Data Transfers/国际数据传输

LSAC is based in the United States and we and our vendors handle and store Personal Information in the United States and, if you take the LSAT outside of the United States, other jurisdictions. The United States and these other jurisdictions may not provide equivalent levels of data protection as the PRC. We transfer Personal Information across borders and may transfer your personal information outside the PRC when we have your consent to do so, or when such handling is otherwise permitted under applicable laws (for example, when the handling is subject to appropriate safeguards and legal rights and remedies). If the transfer is based on your consent, you have the right to withdraw such consent at any time by contacting us as described below, under How to Contact LSAC and Exercise Your Rights. We take steps to safeguard your Personal Information in a manner that provides an adequate level of protection in the jurisdictions in which we handle it.

Data Security, Minimization, and Retention/数据安全、最小化和保留

We use administrative technical and physical security measures to protect personal information, taking into account the nature, scope, context, and purposes of the handling and the risks of varying likelihood and severity for your rights and freedoms. For example, measures of pseudonymization and encryption of personal information; measures for providing ongoing confidentiality, integrity, availability, and resilience of processing systems and services; measures for providing the ability to restore the availability and access to personal information in a timely manner in the event of a physical or technical incident; processes for identifying and remedying personal information breach notification in the event of a security incident; processes for testing, assessing, and evaluating the effectiveness of technical and organizational measures in order to secure the handling of personal information; and measures for identifying and authorizing users and restricting access to personal information.

Our retention periods for Personal Information are based on our business needs and legal requirements. We retain Personal Information for as long as is necessary for the handling purpose(s) for which the information was collected, and any other permissible, related purpose. To investigate, exercise, prepare for, or defend actual or anticipated legal claims, we may also retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired.

At the same time, when required by applicable laws and regulations, we will also take the initiative to report the Handling of Personal Information Breaches in accordance with applicable regulatory requirements.
